In order to maintain our high quality of services expect our customers to act responsible. When you pay for any E-Commerce Total services, in any form, you automatically agree to the following Conditions.

  1. Acceptance of Work

    2. Quotations are valid for 10 days from date of issue.

    E-Commerce Total will carry out work only where an invoice has been paid by the Customer for the work, unless otherwise agreed at Developers discretion.

  2. Domain Names and Hosting

    3. The Customer agrees that registration of a domain name does not provide endorsement of the right to use the name. The Customer is responsible for ensuring they have the right to the domain name. E-Commerce Total holds no liability and the Customer hereby agrees to indemnify and hold harmless E-Commerce Total from any claim resulting from the Customer's registration of a domain name.

    Customer agrees to pass on FTP details and any other access details relating to their domain name and hosting account which the E-Commerce Total requires to upload the web site if required as part of a project.

    Customer agrees to take full responsibility for all usage of the domain name, hosting and email services and to fully abide by the terms and conditions set out by the third party for such services.

  3. Projects

    4. Customer agrees that a HTML page may not look the same in all browsers because of the differences between the rendering of HTML code by internet browser software. Developer agrees to try and match the design as closely as is possible when building the code.

    During a website project it is important that Customer communicates information with us to achieve the required results.

    E-Commerce Total endeavours to create pages that can be crawled by search engine spiders. However, E-Commerce Total gives no guarantee that the site will become listed with search engines.

  4. Travel Time and Expenses

    5. Travelling time to and from our customers premises is not generally included in our quotation. E-Commerce Total reserve the right to make a charge for travelling time at our normal consultancy/training rates. Likewise E-Commerce Total reserve the right to charge for travelling expenses based on 50p per mile. (NOTE: We do not charge for travelling time or expenses incurred before you give your approval for work to start.)

    We recommend that you allow us to work remotely on your computer where possible to save you travelling costs

  5. Indemnification

    6. Customer agrees that it shall defend, indemnify, save and hold us harmless from any and all demands, liabilities, losses, costs and claims, including reasonable attorney's fees asserted against us, our agents, our customers, officers and employees, that may arise or result from any service provided or performed or agreed to be performed or any product sold by customer, it's agents, employees or assigns.

    Customer agrees to defend, indemnify and hold us harmless against liabilities arising out of;

    1. any injury to person or property caused by any products sold or otherwise distributed in connection with our servers;
    2. any material supplied by customer infringing or allegedly infringing on the proprietary rights of a third party;
    3. copyright infringement and any defective products sold to customer from our servers.

  6. Disclaimer

    7. We will not be responsible for any damages your business may suffer. We make no warranties of any kind, expressed or implied for services We provide.

    We disclaim any warranty or merchantability or fitness for a particular purpose. This includes loss of data resulting from delays, non-deliveries, wrong delivery, and any and all service interruptions caused by our Web hosting service and our employees. We reserves the right to revise the policies at any time.

  7. Court Jurisdiction

    8. These Terms and Conditions shall be governed by and construed in accordance with the law of Scotland and the parties hereby submit to the exclusive jurisdiction of the Scottish courts.

  8. Changes to Terms and Conditions

    9. The Seller shall be entitled to alter these Terms and Conditions at any time but this right shall not affect the existing Terms and Conditions accepted by the Buyer upon making a purchase.

Failure to follow any term or condition will be grounds for immediate withdrawal of our services
